BYOD Privacy Notice

1. YOU ARE

  • Owner Driver Franchisee (ODF); or

  • an Owner Driver Worker (ODW); or

  • a Driver or someone who works for, or with our ODFs or ODWs; or

  • a director of a limited company that is an ODF, including where the Directors are guarantor for the ODF; or

  • an agency driver; or

  • a Driver who works for a 3rd party courier company we have engaged; or

  • an independent courier; or

  • a Driver who works for a DPD Local Franchise

In this notice, we refer to all such people as you or your and we ask you all to read this Privacy Notice as it explains what personal information will be collected when using the DPD Saturn App (the App) and to let you know how we use and protect your personal information before downloading and using the App.

In this Privacy Notice, we call such personal information, Personal Data; Personal Data means that it is possible to tell who the person is from the information, when it is used on its own or with other Personal Data we hold about you.


2. WHAT IS BYOD?

BYOD stands for 'Bring Your Own Device'. BYOD relates to bringing a device (your personal mobile phone) to use for work.

For the purposes of managing deliveries DPDgroup UK (DPD UK) requires all drivers listed above to download the 'DPD Saturn App (the App)' onto their personal phone.

The App is available to download from iOS and Android App Stores.

The App is used by drivers to fulfil collection and delivery services using their own device.

3. WHO WE ARE

The mobile application software, DPD Saturn App (the "App") is operated by DPDgroup UK Limited ("DPD UK", "we", "us"), with company number 732993 and registered office Roebuck Lane, Smethwick, West Midlands B66 1BY.

Under the UK data protection laws (Data Protection Act 2018 and UK GDPR), DPD UK is the Data Controller of your Personal Data. This means we decide what information we hold and how we use it.

We have set out below, how and why we hold and use the Personal Data we collect from you when using the DPD Saturn App (the App).
We are registered with the Information Commissioner's Office (ICO) the UK supervisory authority for data protection issues under registration number Z6834529.

Our Data Protection Officer will answer any questions about this Privacy Notice, including questions about your legal rights (see section 6) or any complaints that you may have. You can contact the Data Protection Officer by post using the registered address above or email - dpo@dpdgroup.co.uk
You have the right to make a complaint at any time to the ICO, or any other competent supervisory authority if the App is downloaded outside the UK, about how we use your Personal Data for the operation of the App.

4. THE DATA WE COLLECT ABOUT YOU

We may collect, use, store and transfer different kinds of Personal Data about you through your use of the App, as follows:

  • Device Data - the type of mobile device that you use, a unique device identifier (for example, your device's IMEI number, the MAC address of the device's wireless network interface, or the mobile phone number used by the device), and your mobile operating system;
  • Login Data - your username and password;
  • Usage Data - details of your use of the App, including analytics data where you consent to analytics; and
  • Location Data - your location data while the App is running on your mobile device.
We do not collect any Special Categories of Personal Data about you when using the DPD Saturn App (the App) - this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences when using the DPD Saturn App (the App).

 

 

5. HOW WE USE YOUR PERSONAL DATA & THE LEGAL REASONS WE CAN USE IT

We will only use your Personal Data when the law allows us to do so. Most commonly we will use your Personal Data when using the DPD Saturn App (the App) in the following circumstances:

  • Where you have consented before the processing;
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. 
  • Where we process your Personal Data in pursuit of our legitimate interests, we take steps to ensure that we are only collecting information that we need to ensure that your fundamental rights are not overridden; and
  • Where we need to comply with a legal or regulatory obligation.

 

 

HOW WE USE YOUR PERSONAL DATA

To install the App and register you as a new App user

To manage our relationship with you including notifying you about changes to the App

To administer and protect our business and the App including troubleshooting, data analysis and system testing

Necessary for our legitimate interests - for running our business, provision of administration and IT services, network security. 

Consent - in particular your consent for the use of analytics technologies on your device.

To monitor the services that you are providing to us

Consent - in particular your consent for the use of analytics technologies on your device.


To monitor trends so we can improve the App for users

 

Consent - in particular your consent for the use of analytics technologies on your device. 

Necessary for our legitimate interests -  to keep records updated and to analyse how App users use the App.


5. YOUR LEGAL RIGHTS

In addition to the right to be informed about how we use your Personal Data (as set out in this BYOD Privacy Notice), you have various other rights in respect of the Personal Data we hold about you - these are set out in more detail below:

 

  • Ask us to send you the Personal Data we hold about you;
  • Ask that we put right any Personal Data that is wrong;
  • Ask us to remove Personal Data we hold about you, if we do not have a good reason to continue to process it;
  • Tell us to stop processing your Personal Data if we do not have a good reason by law to continue to process it;
  • Tell us to stop processing your Personal Data to promote or sell items or services to you;
  • To ask us to limit how we use your Personal Data, for example, if you want us to check it is right or to check the reason we are processing your Personal Data;
  • Ask us to send your Personal Data to another person or company. This right only applies to computer based Personal Data which you gave us your permission to use or where we used the Personal Data to perform our contract with you;
  • Where you gave us your permission to use your Personal Data, you can take back your permission. If we use your Personal Data with your permission, we will have asked you for your permission when we collected that Personal Data.

Please note, some of these rights only apply in certain circumstances and we may not be able to fulfil every request. If we receive a request from you to exercise any of the above rights, we may ask you to verify your identity before acting on the request; this is to ensure that your data is protected and kept secure.

6. SHARING YOUR PERSONAL DATA

We may share your Personal Data collected via the App to the following third parties for limited purposes:

  • Other members of our DPD Group for administration or reporting purposes;
  • Technology service providers who provide IT support for the running of the App;
  • Third party data processors engaged by us to assist with the processing and analysis of personal data collected on the App;
  • Customer service providers who work with us to assist you in providing services to us; and
  • Our IT contractors who help with the operation and support of the App.
Occasionally, we may need to disclose your Personal Data collected via the App to third parties where necessary for the legitimate interests of our business or in order to comply with legal obligations, for example:

  • In the event that we sell or buy any business or assets, in which case we may disclose your Personal Data to the prospective seller or buyer of such business or assets;
  • If we have to disclose or share your Personal Data in order to comply with any legal obligation or request from a regulator or governmental agency, or to detect or prevent fraud or crime;
  • With our professional advisers, including lawyers, bankers, auditors and insurers who provide various services to us; and
  • To enforce our agreements, to protect the rights, property or safety of our Group, our customers or others, and in connection with legal claims.

 

7. SENDING PERSONAL INFORMATION OUTSIDE OF THE UK

We may send your Personal Data outside the UK. When we send your Personal Data outside the UK, we will keep to the law, which means we may send data in one of the following ways:

  • We may send your data to countries that the UK says has suitable data protection provisions;
  • We may use contracts approved by the ICO (Information Commissioner's Office) which give Personal Data the same protection it has in the UK; and
  • Where necessary, we will ensure that the appropriate safeguard agreements are in place.

 

 

8. DATA SECURITY

All Personal Data you provide to us when using the App is stored on our secure servers. Where we have given you (or where you have chosen) a password that enables you to access the App, you are responsible for keeping this password confidential. We ask you not to share a password with anyone, for any purposes.

Once we have received your Personal Data, we will use strict procedures and security features to try to prevent your Personal Data from being accidentally lost, used or accessed in an unauthorised way.

We have put in place procedures to deal with any suspected Personal Data breach involving the App and where this affects your data, we will notify you and any applicable regulator when we are legally required to do so.

9.  DATA RETENTION

We will not keep your Personal Data collected via the App for any longer than is necessary for our purposes, including for the purposes of satisfying any legal, accounting or reporting requirements.

10.  COOKIES AND SIMILAR TECHNOLOGIES

We only use strictly necessary cookies in connection with your use of the App.  

 

11. COMPLAINTS

If you are not happy with how DPD UK has handled your Personal Data, please let us know by emailing dpo@dpdgroup.co.uk.
